Model Clauses
Incorporate DBF's Appointment Procedure into Your Contracts.
The Dispute Board Federation (DBF) has developed Model Adjudication Clauses to assist parties, employers, contractors and legal advisers in incorporating a clear and effective adjudication mechanism into their construction contracts.
The clauses provide that, where the parties are unable to agree on the appointment of an adjudicator within the required timeframe, either party may request the DBF to nominate and appoint an adjudicator in accordance with the DBF Rules of Procedure.
Using the DBF Model Clauses helps ensure that disputes can be referred to adjudication without unnecessary delay and that an independent, impartial and suitably qualified adjudicator can be appointed promptly.
The clauses are suitable for inclusion in a wide range of construction and infrastructure contracts and are available in two versions:
- General Construction Contract Clause – suitable for contracts providing for contractual adjudication.
- England & Wales Construction Contract Clause – drafted to operate alongside the Housing Grants, Construction and Regeneration Act 1996 (as amended) and, where applicable, the Scheme for Construction Contracts.
We recommend that parties include one of the DBF Model Clauses at the contract drafting stage to ensure a straightforward and efficient appointment process should a dispute arise.
